On September 17, 2024, a Golenbock Eiseman Assor Bell and Peskoe LLP litigation team – partner Michael Munoz and associate Courtney Howard – secured an arbitration award for a client, fully denying six claims asserted against our client in connection with the client’s sale of a loan. The amount at stake was $8.9 million.
The arbitration concerned a complex agreement governing our client’s sale of a loan secured by a residential apartment development. The claimant asserted that our client breached multiple written representations concerning the loan, the loan’s borrower and the real property securing the loan. The award was issued following a three-day arbitration hearing, which included testimony from five witnesses and two experts. The arbitrator found in favor of our client on the merits of all six claims, and separately on defenses that the claimant had not provided adequate notice of its claims or properly mitigated its damages, resulting in a complete win for our client.
