Thirty-one NYPD officers’ jobs have been protected pending further court proceedings, following a state Supreme Court ruling that denied the city’s request to lift a temporary restraining order blocking their termination. The city is seeking to remove the officers, asserting that they should have been disqualified during the hiring process.
The officers, some of whom have been on the job for over 18 months, were told to resign or face termination when they reported to work last week. The Police Benevolent Association (PBA), represented at the hearing by Golenbock litigation partner Matt Daly, is contesting the attempted terminations in court.
At the hearing, Daly argued that many of the officers come from minority and economically disadvantaged backgrounds and have served without incident, some even earning commendations for their performance. He described the NYPD’s abrupt action as unfair and raised concerns that an NYPD internal investigation is still underway.
Daly argued that the PBA’s position was that the NYPD had no right to revive the disqualifications; however, if it did so, Daly said the officers should be given a right to appeal. “The city is trying to humiliate and condemn them,” he said. “All we’re asking for is that the status quo be maintained.”
