U.S. Senate Passes Act Ending Forced Arbitration of Sexual Assault and Harassment Act


In 2019, GEABP clients Gretchen Carlson, Julie Roginsky and Diana Falzone formed Lift Our Voices, a nonprofit organization dedicated to promoting safe and nondiscriminatory workplaces for all working women.  On February 10, 2022, the U.S. Senate passed the “Ending Forced Arbitration for Sexual Assault and Sexual Harassment Act,” which creates an exception to the Federal Arbitration Act by prohibiting and rendering unenforceable provisions in employment agreements that purport to compel arbitration of sexual harassment and assault claims.   The Bill, which received broad bipartisan support, will become the law of the land when President Biden signs it in the coming days.   Working women who are victims of sexual assault or harassment will no longer be forced into secret arbitration and will be allowed to pursue their claims in court. Upon the passage of the Bill in the U.S. Senate, Gretchen appeared with New York Senators Kirsten Gillibrand and Charles Schumer and offered an inspiring statement, which can be found here.
