Golenbock Wins Federal Appeal, in Distributor Breach of Contract Case, for Boar’s Head Provisions Co. and Frank Brunckhorst Co.


The U.S. Court of Appeals for the Eighth Circuit has unanimously affirmed a summary judgment granted in favor of client Boar’s Head Provisions Co. and its national distributor, Frank Brunckhorst Co., in a case in which a former independent distributor in Minnesota challenged, among other things, Brunckhorst’s decision to terminate the relationship. The appeals court agreed with the district court’s findings concerning the “at will” nature of the relationship, and confirmed Brunckhorst’s right to terminate the relationship after outdated products were found in several of the distributor’s store accounts. Jacqueline G. Veit was lead counsel on the case, joined by Martin S. Hyman, Laura Sulem and Pamela B. Zimmerman.
