Golenbock Obtains Dismissal of Most Claims Asserted Against Mastercard in Wawa Data Breach Case


On September 20, 2023, Judge Nelson Roman of the U.S. District Court for the Southern District of New York granted, in its entirety, Mastercard’s partial motion to dismiss a complaint filed by gas station/convenience store operator Wawa in connection with a data breach affecting numerous Wawa locations. The court dismissed claims for breach of contract, breach of implied covenant of good faith and fair dealing, restitution, unjust enrichment and violations of New York and North Carolina deceptive trade practices statutes.
